Kerala Anti-Social Activities(Prevention) Act 2007 – KAA(P)A Advisory Board – Scheme of Action
Section 3(1) - Reference Cases:
The District Police Chief who is the sponsoring authority recommend the detention of known goonda or known rowdy to the District Magistrate and the District Collector who is the detaining authority. After verification of the report the District Magistrate and the District Collector issues the Detention Order, and report the same to the Government and the Director General of Police.
After receipt of the same, the Government shall place the grounds to the Advisory Board(KAAPA) for its opinion. The Advisory Board shall consider the reference and call for necessary information and conduct hearing if necessary and submit report to the Government as to whether the detention order has sufficient cause or not and suggest that the Government is free to pass confirmation or revocation order accordingly.
Section 15(1) - OP Cases:
The District Police Chief who is the sponsoring authority forward the recommendation for externment or restriction of a known goonda or known rowdy to a police officer of and above the rank of the Deputy Inspector General of Police or the District Magistrate who is the externment authority.
After verification of the report the externment authority issues an Externment or Restriction Order, as per the report. If the Externee file a petition before the Advisory Board on receipt of the order of the Deputy Inspector General of Police, the Board after considering the same and conducting a hearing, if necessary, and modify, set aside or confirm the order of the externment authority.
